Amendments into the labour legislation regarding accounting of employees assigned for business trips

Order of the Ministry of Public Health and Social Development of the Russian Federation dated September 11, 2009 # 739n On the Approval of the order and forms of accounting of employees leaving for business trips from a seconding company and arriving to a company to which they are seconded

The Ministry of Public Health and Social Development of the Russian Federation has approved the order and forms of accounting of employees seconded on business trips. Accounting of seconded employee will be held in departure and arrival journals. The seconding company records the employee data in the departure journal. The company to which the employee has been seconded records the data in the arrival journal. The journal samples are given in the Appendixes to the Order.

The Order stipulates that the employer is obliged to keep the journals for five years as of the date of their issuing. An employee has to be appointed responsible for keeping the journals and for putting relevant notes in business trips certificates.

Approval of this order complicates business trips for foreign nationals to the regions for which they do not have work permits. Seconding of foreign employees on business trips is regulated by the Decree of the Government of Russia dated 17.02.2007 # 97. It stipulates the period of staying of foreign employees on a business trip not longer than 10 calendar days within the whole period of validity of a work permit or 60 calendar days in case of a travelling kind of work. However, up to the moment there was no control over movements of foreign employees on business trips. Coming into effect of the Order has led to such control, and inspection state authorities have gained an opportunity to impose sanctions for particular violations of labour and migration legislation.

The order was published in the “Bulletin of statutory acts of federal executive bodies”, # 44, 02.11.2009 and came into force 13.11.2009.
